Halle Berry is going to court early Monday to file a restraining order against ex-boyfriend Gabriel Aubry after he showed up at her house on Thanksgiving Day and got into a fight with fiancé Olivier Martinez.
The fight happened right in front of Berry’s 4-year-old daughter, Nahla.
Although a judge issued an emergency order of protection — requiring Aubry to stay 100 yards away from Berry, Nahla and Martinez — that order expires Tuesday. However, Berry’s lawyers will be in family court asking a judge to extend that protection for an indefinite period of time.
The fight at Berry’s home landed both Aubry and Martinez in the same hospital Emergency Room.
Aubry was quickly was arrested at the hospital and could be charged with criminal battery.
Sources tell TMZ … Berry’s argument is pretty simple — if Aubry can’t control himself enough to protect Nahla from emotional trauma, it’s too risky for him to be around the child.
Berry could use this incident to move herself and Nahla to France, which was recently turned out after Aubry argued the motion in court.
