'Harry Potter Condoms' is much different than the actual Popper brand.
'Harry Potter Condoms' maker sued by Warner. Warner Bros is suing the makers of Harry Popper Condoms, over 'Harry' trademark rights. But, is the Harry Potter lawsuit legitimate over the Popper brand?
The entertainment force behind the Harry Potter films, is suing a Swiss condom maker for copyright infringement over the condom brand name Harry Popper. "Our product has nothing to do with Harry Potter," stated a spokesperson for the company. The condoms are made by Magic X.
The lawyer for this company stated, "Our product has nothing to do with Harry Potter." The brand was launched in 2006 and the name was registered with Swissreg, the Swiss Federal Institute of Intellectual Property. The Cantonal Court in Schwyz will rule in the coming weeks on whether to ban the product.
"The image of my client is in danger," stated a lawyer for Warner Bros. "This is clearly a reference to the film and fictional character Harry Potter. Everyone who sees the condoms automatically thinks of Harry Potter." The product features an illustration of a condom wearing round glasses and waving a magic wand on the packet.
