Adam Lambert battery charge pending? The singer allegedly attacked the paparazzi outside on the beach.

Singer Adam Lambert is being accused of committing battery on a paparazzo. The incident allegedly happened outside of a South Beach hotel.

"Eeew paparazzi killed my peaceful afternoon on the beach!," Lambert tweeted on Thursday. "#howisthisok?"

According to police reports, 38-year-old Victor Eras was taking pictures of Lambert when he began running toward him "in an aggressive manner." In addition, the paparazzo claimed that Lambert grabbed at his backpack as he ran away, then wrestled him to the ground. However, there were no bruises or cuts found on Eras that would constitute battery.

"I attempted to grab a camera, no punches were thrown and no one was on the ground... It was literally harmless. If embarrassment is a crime- thats all I'm guilty of," stated Lambert.

The police department will not be pressing charges. So, if Eras feels he has a case, he will have to take it up with the state attorney's office. Meanwhile, the former American Idol contestant will be performing in Melbourne, St. Petersburg and Hollywood, Fla. on Friday, Saturday and Sunday.
