Alabama Football Fan Brian Downing Sentenced For Obscenity

Alabama football fan Brian Downing was sentenced to two years in prison after his early 2012 obscenity of a drunken LSU fan after the BCS Championship game.

Downing was caught on video rubbing his bare genitals on the neck of a drunken and passed out LSU fan as he and other Alabama fans celebrated the school’s victory over LSU in the championship game in January at the Bourbon Street Krystal Burger restaurant, in New Orleans.

The drunken LSU fan appears to be alone, passed out on a counter. He remained slumped across the table as the Alabama group balanced food containers on him and shouted “Roll Tide!” Downing, in the video that went viral, then pulls his genitals from his pants and rubs them across the man’s neck.

Downing’s cousin, Heath Taylor, a Russell County, Ala., Sheriff, eventually saw the video and called Downing’s father to encourage him to have his son turn himself in to authorities.

The 33-year-old Downing had originally been charged with sexual battery, which if convicted would have come with a maximum penalty of 10 years in prison, and he would have to register as a sex offender. However, the Alabama fan brokered a deal to plead guilty to two lesser counts of obscenity.

At his Thursday sentencing, Criminal Court Judge Karen Herman called Downing a “bully,” adding: “You chose wisely to enter into this plea bargain. The actions that you took on Jan. 9 of this year were morally reprehensible, there’s no way around it.”

The victim in the video is now planning a lawsuit against Downing and the restaurant chain in which the incident took place.
